Refco has continued to dismiss Trading Technologies (TT)'s
right to terminate its contract to provide software, stating in
its latest court filing that TT's actions are in breach of
Citing "decades of Illinois precedent," Refco stated that
the case, "involves bad faith termination, and even at-will
contracts cannot be terminated in bad faith or for improper
motive". It also said that its counterclaims and affirmative
defence of patent misuse were "all based on TT's efforts to
leverage its patents and licensing contracts with Refco to
advance its confessed goal of forcing the industry to pay it
five cents forever for every contract traded, whether or not
software is even used in trading."
