In the request, made to Northern Illinois District Court,
Espeed said that it "has evidence that, during the prosecution
of the patents in suit, TT and its agents knowingly withheld
information from the Patent and Trademark Office pertaining to
public use of the invention, despite a specific, express
request by the examiner for this information."
