Eurex ceo Rudi Ferscha defended the filing and timing of the
lawsuit against CBoT and CME, saying that it had been
undertaken in response to CBoT's 8 October letter to clearing
firms and with the aim of removing the anti-competitive element
from the vote on The Clearing Corporation (TCC)'s restructuring
Ferscha told FO Week he did not think the lawsuit
would have an impact on the CFTC's approval process, nor on the
vote. On the contrary, the lawsuit was filed because "we want
to make sure there is no negative impact on that vote," he
